Acceptance of Terms

By downloading, installing, or using the ABH.CARE mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Alpha Behavioral Health regarding your use of the App.

Description of Service

The App provides a convenient way for patients of Alpha Behavioral Health to:

  • View upcoming appointments

  • Receive appointment reminders

  • Cancel or modify appointments

  • Switch between telehealth and in-person visits

  • Access telehealth services

  • View account balance information

  • Find our office locations

The App is intended to supplement, not replace, direct communication with your healthcare providers.

Eligibility

To use this App, you must:

  • Be at least 18 years old, or have parental/guardian consent

  • Be an existing or prospective patient of Alpha Behavioral Health

  • Have a valid phone number capable of receiving SMS messages

  • Agree to these Terms and our Privacy Policy

Account Registration & Security

You are responsible for:

  • Providing accurate and complete information during registration

  • Maintaining the security of your account credentials

  • All activities that occur under your account

  • Notifying us immediately of any unauthorized use

We verify your identity using SMS verification codes sent to your registered phone number. Do not share your verification codes with anyone.

Appointment Policies

Cancellation Policy

Appointments cancelled less than 24 hours before the scheduled time may be subject to a $50 late cancellation fee.

Appointment Changes

You may change your appointment mode between telehealth and in-person visits through the App, subject to provider availability and clinical appropriateness.

Telehealth Services

By using our telehealth services, you acknowledge that video visits may have limitations compared to in-person care and that technical issues may sometimes affect service delivery.

Not for Emergencies

THIS APP IS NOT FOR EMERGENCY SITUATIONS.

If you are experiencing a medical or mental health emergency, please:

  • Call 911

  • Go to your nearest emergency room

  • Call the National Suicide Prevention Lifeline: 988

  • Palm Springs Crisis Center at 2500 N Indian Canyon 760-424-5602 for mental health emergencies

The App is not monitored 24/7 and should not be used for urgent communications.

Medical Disclaimer

The App is a tool for managing your appointments and accessing certain healthcare services. It does not:

  • Provide medical advice, diagnosis, or treatment

  • Replace the relationship between you and your healthcare providers

  • Guarantee appointment availability

  • Serve as a complete medical record

Always consult with your healthcare provider for medical advice and treatment decisions.

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose

  • Attempt to gain unauthorized access to our systems

  • Interfere with or disrupt the App’s functionality

  • Share your account credentials with others

  • Impersonate another person or misrepresent your identity

  • Use the App to transmit harmful or malicious content

  • Attempt to reverse engineer the App

Intellectual Property

The App and its original content, features, and functionality are owned by Alpha Behavioral Health and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Push Notifications

By enabling push notifications, you consent to receive:

  • Appointment reminders

  • Important account notifications

  • Service updates

You can disable notifications at any time through your device settings.

Limitation of Liability

To the maximum extent permitted by law, Alpha Behavioral Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use or inability to use the App

  • Any errors or omissions in the App’s content

  • Technical failures or service interruptions

  • Unauthorized access to your information

Our total liability shall not exceed the amount you have paid to use the App (if any).

Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:

  • The App will be uninterrupted or error-free

  • Defects will be corrected

  • The App is free of viruses or harmful components

  • The information provided is accurate or complete

Modifications to Service

We reserve the right to:

  • Modify or discontinue the App at any time

  • Update these Terms with reasonable notice

  • Change features or functionality

  • Limit or restrict access to the App

Continued use of the App after changes constitutes acceptance of the modified Terms.

Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe:

  • Violates these Terms

  • Is harmful to other users or our business

  • Is fraudulent or illegal

You may stop using the App at any time by logging out and uninstalling the App.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.
